Summary
On June 9, 2020, the Financial Services Tribunal (FST) dismissed an appeal filed by Mr. Inglis to the Liability and Penalty Decisions of the Real Estate Council of British Columbia (the Council).
As a result of the FST's decision, the Decision of the Council's Discipline Committee is no longer stayed and its order will take effect as follows: Mr. Inglis’ licence will be suspended for the later of nine (9) months from July 29, 2020 inclusive, until:
- April 29, 2021, and
- the date he complies with all the other requirements of the Decision (see paragraphs 52, 54, 64(c) and 65 of the Decision).
On April 24, 2019, a Discipline Committee of the Council has found that Mr. Inglis committed professional misconduct in that he:
- engaged in deceptive dealing by fabricating or altering an Offer (the "Offer") and asserting that it was an offer on the property in issue in North Vancouver (the "Property");
- made a false statement to the Council in his response to the allegations made against him when he denied the "penmanship" in the Offer was his; and
- committed conduct unbecoming a licensee when he threatened retaliation against his co-listing agent for making a complaint against him to the Council.
Results
The Discipline Committee ordered that Mr. Inglis:
- be suspended for the later of nine months, and the date he satisfies other requirements (see paragraphs 52, 54, 64c and 65 of the Decision Regarding Penalty), generally from June 1, 2019 to February 29, 2020 inclusive;
- be prohibited from acting as an unlicensed assistant during the suspension period;
- pay a discipline penalty of $7,500;
- pay enforcement expenses of $39,022.87; and
- successfully complete courses in Ethics and Respectful Communications in Workplace, at his own expense.
