Summary
A qualification hearing was held to determine the Applicant’s suitability to be licensed. The circumstances considered at the hearing included the following:
- [The Applicant’s] communication with Council staff was unprofessional, disrespectful, and demonstrated issues concerning [the Applicant’s] governability;
- [The Applicant] failed to respect requests from Council staff to limit communication to the staff member who had conduct of [the Applicant’s] matter;
- The bookkeeping and recordkeeping issues that arose while [the Applicant] was the Managing Broker of [the Brokerage], including the bookkeeping and recordkeeping issues identified in the Accountant’s Reports from 2013, 2014, 2015, 2016, and 2017 as well as [the Applicant’s] failure to file the Accountant’s Reports within the timeline required by s. 7-7 of the Rules in 2013, 2014, 2015, and 2017; and
- The nature of the conduct that gave rise to criminal charges against [the Applicant] on or around September 21, 2017, October 17, 2017, and February 4, 2018, notwithstanding that these charges were stayed on or around June 4, 2018.
Results
A Hearing Committee found that the Applicant is not of good reputation and not suitable to be licensed. The Hearing Committee imposed a period of three years before the Applicant could re-apply for licensure.
