Summary
Kevin Pearson, as managing broker, paid an unlicensed Personal Real Estate Corporation for real estate services provided on behalf of Century 21 Energy Realty. His actions contravened section 7(3)(b) of the Real Estate Services Act and section 6-1 of the Rules.
Mr. Pearson failed to verify that the Personal Real Estate Corporation was in compliance with the licensing requirements of the Real Estate Services Act. His actions contravened his responsibilities under section 6(2) of the Real Estate Services Act, and sections 3-1(1) and 3-1(3)(b) of the Rules.
By permitting an unlicensed Personal Real Estate Corporation to provide real estate services, Century 21 Energy Realty contravened section 7(5)(a) of the Real Estate Services Act.
Results
A discipline committee of the Council has ordered the following:
- Mr. Pearson and Century 21 Energy Realty are each reprimanded.
- Mr. Pearson must pay enforcement expenses of $1,500.00 to the Council.
- Century 21 Energy Realty must pay enforcement expenses of $1,500.00 to the Council.
As Mr. Pearson has a Personal Real Estate Corporation, the licence of Kevin Pearson Personal Real Estate Corporation is also reprimanded, and is equally responsible for payment of Mr. Pearson's enforcement expenses.
