Summary
A discipline committee of the Real Estate Council of British Columbia (the "Council") accepted the Consent Order Proposal submitted by Harwinder Singh Dial and Harwinder Dial Personal Real Estate Corporation, and found that they:
- committed professional misconduct when acting as the buyer's agent in the sale of the Property, a new home built by an owner builder under the provisions of the Homeowners Protection Act, and in particular, Mr. Dial failed to act with reasonable care and skill when he did not ensure that the buyer received a copy of a Owner Builder Disclosure Notice prior to the buyer making an offer of purchase and sale; and
- committed professional misconduct when Mr. Dial failed to cooperate with a Council investigation, particularly by providing false information to Council during its investigation of this matter.
Results
A discipline committee of the Council has ordered, and Harwinder Singh Dial and Harwinder Dial Personal Real Estate Corporation have agreed to, the following penalties:
- a reprimand;
- a discipline penalty of $3,500, jointly and severally liable;
- enforcement expenses of $1,500, jointly and severally liable; and
- successful completion of the Real Estate Trading Services Remedial Education Course.
