Real Estate Inspection and Appraisal Services
If you are licensed under the Real Estate Services Act (“RESA”), any services you provide that can be defined as trading services, rental property management, or strata property must be provided through the brokerage you are licensed with. This includes real estate inspection or appraisal services.
There is an exemption from the requirement to be licensed for persons providing real estate inspection and/or appraisal services. However, this exemption only applies if those services are provided in the course of the person’s business as an appraiser or real estate inspector, and not to those who are already licensed under RESA.
The exemption can be found in Section 2.8 of the Real Estate Services Regulation (the “Regulation”), and it provides an exemption from the requirement to be licensed for a person who only provides the following trading services:
- An appraisal of value of real estate and consulting services relating to the value of real estate; or
- Inspecting and reporting on the condition of the real estate.
Section 2 of RESA states that a person who is licensed to provide real estate services is not able to act under these exemptions. Accordingly, a licensee providing the services identified in the Section 2.8 Regulation exemption must do so in the name of and on behalf of their related brokerage, and any remuneration received for providing these services must be paid to and received from that brokerage.
