Real Estate Licensee’s Licence Suspended for Conduct Unbecoming Stemming From a Traffic Stop
BCFSA has suspended David William Rodney Foxwell’s real estate licence for engaging in conduct unbecoming of a licensee under the Real Estate Services Act (“RESA”), after he was convicted in the Alberta Court of Justice of several offences stemming from a traffic stop.
Foxwell was convicted of six charges arising from a December 15, 2021 Alberta traffic stop when he refused to put his vehicle into park, resisted arrest, assaulted a police officer, refused to provide a breath sample, and refused to provide his name. Foxwell received a conditional sentence, probation, community service, fines, and a three-year driving prohibition from the Alberta Court of Justice.
In response to these criminal actions by Foxwell, BCFSA conducted its own regulatory investigation and following a hearing, Foxwell was found to have committed conduct unbecoming by violating sections 43(1)(a) and 43(2) of RESA. Conduct unbecoming is when a licensee engages in any conduct, even during their personal time, that in the judgement of the Superintendent of Real Estate:
- Is contrary to the best interests of the public;
- Undermines public confidence in the real estate industry; or
- Brings the real estate industry into disrepute.
Foxwell’s licence will be suspended for 10 months until June 2026, at which time his licence can be reinstated. Foxwell is also required to pay $17,298.50 to BCFSA for investigation and hearing expenses.
