Xiao Ming (Alban) Wang, while licensed with Amex Sunrich Realty, Richmond, accepted 17 client referrals from an unlicensed brokerage between November 2012 and July 2013. After the completion of each property sale, Mr. Wang paid referral fees to the unlicensed brokerage. Mr. Wang's actions contravened section 6-1 of the Council Rules.
Mr. Wang failed to disclose to his clients that he was paying referral fees to the unlicensed brokerage. This contravened section 3-3(f) of the Council Rules.
Mr. Wang failed to act honestly and with reasonable care and skill when he prepared an offer for a property in Richmond, BC, on behalf of a purchaser whom he never met. His actions contravened section 3-4 of the Council Rules.
Mr. Wang provided real estate services other than on behalf of the brokerage to which he was licensed when he provided real estate services on behalf of the unlicensed brokerage. This contravened section 7(3)(a) of the Real Estate Services Act.
Mr. Wang failed to keep his managing broker informed of his relationship and arrangements with the unlicensed brokerage, which contravened section 3-2(2)(a) of the Council Rules.
When he encouraged unlicensed activity by providing real estate services to the unlicensed brokerage and paid remuneration to them in the form of referral fees, Mr. Wang engaged in conduct unbecoming a licensee. His actions contravened section 35(2) of the Real Estate Services Act.
A discipline committee of the Council has ordered the following:
- Mr. Wang's licence is suspended for a period of one year from August 24, 2016 to August 23, 2017 inclusive.
- Mr. Wang must pay a discipline penalty of $10,000.00 to the Council.
- At his own expense, Mr. Wang must successfully complete the Real Estate Trading Services Remedial Education Course.
- Mr. Wang must pay enforcement expenses of $1,500.00 to the Council.
As Mr. Wang has a personal real estate corporation, the licence of Alban Wang Personal Real Estate Corporation is also suspended, and it is equally responsible for the payment of the discipline and enforcement expenses.
